1. Overview

QC Tool Swap, operated by River Basin Holdings LLC, is a peer-to-peer platform that enables individuals to rent, buy, or swap home power tools with neighbors. This agreement outlines the responsibilities of users and the terms governing all transactions on the platform.


2. Seller Responsibilities

  • Sellers agree to provide tools that are in safe, functional, and operable condition at the time of rental, sale, or swap.
  • Sellers must provide accurate descriptions of the tool's condition and functionality.
  • Sellers are responsible for ensuring tools are clean and ready for use prior to handoff.
  • Sellers are not liable for any damages, injuries, or losses resulting from the purchaser's use or misuse of the tool.

3. Purchaser Responsibilities

  • Purchasers assume full responsibility for the care, handling, maintenance, and proper usage of any tool obtained through QC Tool Swap.
  • Purchasers agree to inspect tools upon receipt and report any issues immediately.
  • Purchasers are solely responsible for operating tools safely and in accordance with manufacturer guidelines.
  • Under no circumstances shall the seller be held liable for misuse, negligence, or improper handling by the purchaser.

4. Insurance and Risk Assumption

  • All users acknowledge that QC Tool Swap does not provide insurance coverage for tools, transactions, or personal injury.
  • Sellers and purchasers are responsible for securing their own insurance coverage, including but not limited to homeowners, renters, or personal liability insurance.
  • By participating in any transaction, users assume all risks associated with the use, handling, and exchange of tools.
  • River Basin Holdings LLC may offer optional insurance coverage in the future, at its sole discretion.

5. Dispute Resolution

  • In the event of a dispute between users, QC Tool Swap encourages direct communication between the parties to resolve the issue at the lowest level possible.
  • If resolution cannot be reached, the default remedy is the return of both the tool and any associated payment.
  • In cases where a tool is damaged, non-functional, or misrepresented, the platform will typically favor the seller if the tool was provided in good faith and the issue stems from misuse.
  • River Basin Holdings LLC may offer informal mediation but does not guarantee enforcement or outcomes.

6. Platform Enforcement

  • QC Tool Swap is operated by a solo founder and currently maintains limited enforcement capabilities.
  • Users are expected to act in good faith and uphold the spirit of community trust and mutual respect.
  • River Basin Holdings LLC reserves the right to suspend or remove users who repeatedly violate platform policies or engage in fraudulent behavior.
  • As the platform grows, additional enforcement mechanisms may be introduced.

7. Limitation of Liability

  • River Basin Holdings LLC and QC Tool Swap act solely as a facilitator of peer-to-peer transactions.
  • The company is not responsible for the condition, safety, legality, or performance of any tools exchanged.
  • All transactions are conducted at the users' own risk.

8. Agreement to Terms

By using QC Tool Swap, all users acknowledge and agree to the terms outlined in this policy. Continued use of the platform constitutes acceptance of these terms.
